Welcome to Homeschool Moment. By accessing or using our mobile application, you agree to be bound by these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, or using Homeschool Moment ("the App"), you agree to these Terms of Service and our Privacy Policy. If you do not agree to these terms, please do not use the App.

You must be at least 18 years old or have parental consent to use this service.

2. Description of Service

Homeschool Moment is a mobile application that helps homeschool parents:

• Capture and organize photos of learning activities
• Generate AI-powered educational descriptions
• Track children's educational progress
• Export records as PDF documents
• Backup data to cloud storage (premium feature)

3. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Providing accurate and complete information

We reserve the right to suspend or terminate accounts that violate these terms.

4. Subscriptions and Payments

Free Tier

The free tier includes 5 entries per calendar month, 1 student profile, AI-generated descriptions, and watermarked PDF exports. Free entry limits reset at the beginning of each calendar month.

Premium Subscription

Premium subscriptions are available as:

• Monthly: $12 per month
• Yearly: $99 per year

Billing

• Subscriptions are billed in advance on a recurring basis
• Payment is processed securely through the Apple App Store or Google Play Store
• You can cancel your subscription at any time
• Cancellation takes effect at the end of the current billing period

Refunds

Refund requests are handled on a case-by-case basis. Please contact our support team for assistance.

5. Referral Program (Share & Earn)

Eligibility

The Homeschool Moment Referral Program ("Share & Earn") is available exclusively to users with an active Premium subscription. By participating in the program, you agree to the following terms.

Commission Structure

• You earn a $10 commission for each new user who subscribes to a Premium plan using your unique referral link
• Commissions are earned on both monthly and yearly subscription purchases
• There is no limit to the number of referrals you can make
• Commissions are only paid on the initial subscription purchase, not on renewals

Payment Terms

• Commissions are processed through our third-party affiliate platform (Tapfiliate)
• Payouts are subject to minimum thresholds and processing times set by the affiliate platform
• You are responsible for providing accurate payment information
• You are solely responsible for any tax obligations related to referral earnings

Prohibited Referral Activities

The following activities are strictly prohibited and may result in immediate termination from the program and forfeiture of pending commissions:

• Self-referrals or creating fake accounts to earn commissions
• Using paid advertising that includes our brand name or trademarks
• Spam, unsolicited messaging, or misleading promotional tactics
• Making false claims about our service or subscription benefits
• Incentivizing sign-ups through cash-back offers or commission splitting
• Any fraudulent, deceptive, or illegal promotional methods

Program Modifications

We reserve the right to:

• Modify commission rates or program terms at any time with reasonable notice
• Suspend or terminate your participation for any violation of these terms
• Withhold or reverse commissions obtained through fraudulent means
• Discontinue the referral program entirely at our discretion

No Guarantee of Earnings

Participation in the referral program does not guarantee any specific level of earnings. Results depend on your individual promotional efforts and are not guaranteed by Homeschool Moment.

6. User Content

Your Rights

You retain all rights to the photos and content you create using the App. By using our service, you grant us a limited license to process your content for the purpose of providing our services (such as generating AI descriptions).

Your Responsibilities

You are responsible for ensuring you have the right to share any content you upload, including photos of your children.

Content Guidelines

You agree not to upload content that:

• Violates any laws or regulations
• Infringes on intellectual property rights
• Contains harmful, abusive, or inappropriate material
• Violates the privacy of others

7. Prohibited Uses

You may not:

• Use the App for any unlawful purpose
• Attempt to reverse engineer or hack the App
• Distribute malware or harmful code
• Impersonate others or provide false information
• Use the App to spam or send unsolicited communications
• Circumvent subscription requirements

8. Intellectual Property

The App, including its design, features, and content (excluding user content), is owned by Homeschool Moment and protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on the App without our written permission.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:

• The App will meet your specific requirements
• The App will be uninterrupted, timely, or error-free
• AI-generated descriptions will be completely accurate
• Any errors in the App will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOMESCHOOL MOMENT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING:

• Loss of data or content
• Loss of profits or revenue
• Damage to devices
• Personal injury or property damage

Our total liability shall not exceed the amount you paid us in the past 12 months.

11. Termination

We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including:

• Violation of these Terms
• Fraudulent or illegal activity
• At our sole discretion

Upon termination, your right to use the App will cease immediately. You may delete your account and data at any time through the App settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the App or via email.

Your continued use of the App after changes are posted constitutes acceptance of the modified terms.
